Motion by Golden, seconded by Adamson to recommend approval of the minutes as submitted.
All “ayes” Motion carried.
4. REZONINGS–
Motion by Mooney, seconded by Golden to receive and file correspondence the City received on September 12, 2005 from James R. Wainwright of Ahlers & Cooley, P.C. dated September 8, 2005 regarding the proposed rezoning of property located south of County Home Road east and west of Highway 13 from Linn County A, Agricultural; A-F, Agricultural Farmstead Overlay;I-1, Light Industrial; OT, Office-Transitional and A-R-5A, Agricultural/Residential-Subdistrict 5 Acre Lots to Marion A-1, Rural Restricted per Section 176.07-7(A) of the Marion Zoning Code
All “ayes” motion carried.
a. Public hearing regarding City initiated rezoning of property located south of County Home Road east and west of Highway 13 from Linn County A, Agricultural; A-F, Agricultural Farmstead Overlay;
I-1, Light Industrial; OT, Office-Transitional and A-R-5A, Agricultural/Residential-Subdistrict 5 Acre Lots to Marion A-1, Rural Restricted per Section 176.07-7(A) of the Marion Zoning Code.
Treharne presented the staff report regarding the proposed rezoning request. Treharne stated that per Section 176.07-7(A) of the Code of Ordinances, no application has been made by the property owners to rezone; therefore, the City is recommending rezoning to A-1, Rural Restricted all property identified. The A-1, Rural Restricted zoning classification will act as a holding district and is compatible with the Future Land Use Map of the Marion Comprehensive Plan.
Ed Mulholland, 2888 Silver Oak Trail, Marion stated that he fully supports the rezoning of the property to bring the area into conformance with the Marion Future Land Use Map and to preserve Marion’s future growth.
Bob Copper, 2265 Daleview Drive, stated that he is a property owner whose property is being rezoned and that he fully supports the proposed A-1 zoning to hold his property for future development.
Steve Wilkins, 640 Telluride Trail, stated that he supports the proposed rezoning.
Bill Copper, 1055 Edwin Drive, stated that he supports the rezoning of his family’s property and the adjacent properties.
There were no additional comments for or against the proposed rezoning request, the public hearing was closed.
b. CPC Resolution No. 05-30 regarding City initiated rezoning of property located south of County Home Road east and west of Highway 13 from Linn County A, Agricultural; A-F, Agricultural Farmstead Overlay; I-1 Light Industrial; OT, Office-Transitional and A-R-5A, Agricultural/Residential-Subdistrict 5 Acre Lots to Marion A-1, Rural Restricted per Section 176.07-7(A) of the Marion Zoning Code.
Motion by Mooney, seconded by Neighbor to recommend approval of CPC Resolution No. 05-30 regarding City initiated rezoning of property located south of County Home Road east and west of Highway 13 from Linn County A, Agricultural; A-F, Agricultural Farmstead Overlay; I-1 Light Industrial; OT, Office-Transitional and A-R-5A, Agricultural/Residential-Subdistrict 5 Acre Lots to Marion A-1, Rural Restricted per Section 176.07-7(A) of the Marion Zoning Code.
All “ayes” motion carried.
5. COMPREHENSIVE PLAN AMENDMENT -
a. CPC Resolution No. 05-31 regarding an amendment to the Future Land Use Map of the Marion Comprehensive Plan and the Major Street Ordinance eliminating 50th Street designation as a Collector between 29th Avenue and 35th Avenue.
Hockett presented the staff report regarding the proposed amendment to the Marion Comprehensive Plan and Major Street Ordinance. Hockett stated that 50th Street is no longer needed as a collector street with the location of both 44th Street and Highway 13 serving similar functions and that the area can be adequately served by a residential street network.
Mooney stated that he understands the removal of 50th Street, but feels that the City must study and prepare a plan for the transportation network north of 29th Avenue and south of Indian Creek Road
Motion by Mooney, second by Adamson to recommend approval of CPC Resolution No. 05-31 regarding an amendment to the Future Land Use Map of the Marion Comprehensive Plan and the Major Street Ordinance eliminating 50th Street designation as a Collector between 29th Avenue and 35th Avenue and directing staff to prepare a transportation study of the area between 29th Avenue and Indian Creek Road west of Highway 13.
All “ayes” motion carries.
6. OTHER BUSINESS.
There was no additional business to come before the Marion Planning and Zoning Commission.

There being no further business to come before the Commission, the meeting was adjourned at 7:15 PM.
