PLANNING AND ZONING COMMISSION
JUNE 14, 2005
1. CALL TO ORDER.
Chairman Siedl called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 PM.
2. ROLL CALL.

3. MINUTES -

Motion by Mooney, seconded by Neighbor, to approve the minutes from the May 14, 2005 minutes as submitted.
All “ayes” motion carried.
4. PLATS -
a. CPC Resolution No. 05-14 regarding Creekview Addition Preliminary Plat for A-1 zoned property located between the abandoned railroad right-of-way and Indian Creek in Marion, Iowa. (Case #05-59)
Treharne presented the staff report regarding the proposed preliminary plat and preliminary cluster development plan. Treharne explained that the developer could develop lots in the A-1, Rural Restricted as long as the balance of the property is left undeveloped.
John Dusek, representing the owner, stated that the proposed development is 4 feet above the flood elevation and 14 feet above the creek line. Mr. Dusek explained that they have removed several buildings from the original request and feels they have met the concerns of the City Council and adjacent property owners.
Ace Aossey, owner of the property, stated that they have worked hard to develop a plan for the site that meets the need of the City and address the concerns of the adjacent property owners and feel that the plan presented meets those concerns.
Vicki Stanley, 185 Grand Avenue, stated that she was concerned about the destruction of natural green space and is concerned about the amount a traffic that will be on Grand Avenue as a result of this development.
Pat O’Connell, inquired to the status of the Alliant Energy light pole.
Steigerwaldt explained that Alliant Energy would be relocating the pole in the near future.
There were no additional comments for or against the proposed preliminary plat and cluster development plan.
Motion by Adamson, seconded by Mooney, to recommend approval of CPC Resolution No. 05-14 regarding Creekview Addition Preliminary Plat for A-1 zoned property located between the abandoned railroad right-of-way and Indian Creek in Marion, Iowa subject to staff comments.

b. CPC Resolution No. 05-15 regarding Creekview Addition Preliminary Site Development Plan – Cluster Development Plan for A-1 zoned property located between the abandoned railroad right-of-way and Indian Creek in Marion, Iowa. (Case #05-59)
Motion by Nesteby, seconded by Adamson, to recommend approval of CPC Resolution No. 05-15 regarding Creekview Addition Preliminary Site Development Plan – Cluster Development Plan for A-1 zoned property located between the abandoned railroad right-of-way and Indian Creek in Marion, Iowa.
Ayes: Golden, Adamson, Techau, Mooney, Nesteby, Olson, Seidl
Nays: Neighbor
Motion carried (7-1)
5. REZONING -
a. Discussion regarding Preliminary Development and Concept Plan for property located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa from A-1, Rural Restricted to R-2, Medium Density, Single-Family Residential and R-4, Four-Family Residential.
Treharne presented the staff report regarding the proposed concept plan. Treharne reviewed the history of the property explaining that due to the previous illegal split of the property the owner(s) of the properties are required to correct the split prior to development of the property. The applicants were looking for indication of support from the Commission prior to proceeding further with the project.
Mooney stated that development of the property is key to Marion and was supportive of any solution to encourage the platting of the property.
Adamson stated he would encourage the developers to develop a plat and bring it back before the Commission for review.
b. Public hearing regarding Gary and Dianne Eschman, owners and Fritz Development, L.L.C, applicant, request to rezone property located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa from A-1, Rural Restricted to R-2, Medium Density, Single-Family Residential and R-4, Four-Family Residential.
Hockett presented the staff report regarding the proposed rezoning request. Hockett stated that staff was supportive of both the R-2 and R-4 zoning except for the portion in the northwest corner of the development proposed for R-4 rezoning, but would support R-2 zoning
Karl Rosenburg, stated that they would be agreeable to the R-2 zoning in the northwest corner of the development and would withdraw the R-4 request in this location. Mr. Roseburg stated that development of this property will result in the connection between Winslow Road and 10th Street being closer to realty and would result in sewer being brought up that would serve most of the undeveloped property in the immediate area.
There were no comments for or against the proposed rezoning request.
c. CPC Resolution No. 05-16 regarding Gary and Dianne Eschman, owners and Fritz Development, L.L.C, applicant, request to rezone property located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa from A-1, Rural Restricted to R-2, Medium Density, Single-Family Residential and R-4, Four-Family Residential. (Case #05-06)
Motion by Mooney, seconded by Techau, to recommend approval of CPC Resolution No. 05-16 regarding Gary and Dianne Eschman, owners and Fritz Development, L.L.C, applicant, request to rezone property located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa from A-1, Rural Restricted to R-2, Medium Density, Single-Family Residential and R-4, Four-Family Residential with the condition that the proposed R-4, Four Family Residential zoning located north the proposed detention pond and south of the Nemer property be removed and rezoned to R-2 to be compatible with the adjacent zoning and land uses.
All “ayes” motion carried.
d. Public hearing regarding Eagle Ridge, L.L.C. request to rezone property located west of Red Fox Way, south of Kacena Avenue in Marion, Iowa from C-3, General Commercial to R-5, Moderate Density, Multiple-Family Residential.
Hockett presented the staff report regarding the proposed rezoning request stating that the request was in conformance with the Future Land Use Map and that the down zoning of the property would result in the property being closer to conformance with adjacent developments. Staff recommends approval of the proposed request.
There were no additional comments for or against the proposed request.
e. CPC Resolution No. 05-17 regarding Eagle Ridge, L.L.C. request to rezone property located west of Red Fox Way, south of Kacena Avenue in Marion, Iowa from C-3, General Commercial to R-5, Moderate Density, Multiple-Family Residential. (Case #05-08)
Motion by Techau, seconded by Mooney, to recommend approval of CPC Resolution No. 05-17 regarding Eagle Ridge, L.L.C. request to rezone property located west of Red Fox Way, south of Kacena Avenue in Marion, Iowa from C-3, General Commercial to R-5, Moderate Density, Multiple-Family Residential subject to staff comments.
All “ayes” motion carried.
