MINUTES
PLANNING AND ZONING COMMISSION
DECEMBER 14, 2004

1.                  CALL TO ORDER.

Vice Chairman Mooney called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 P.M.
 
2.                  ROLL CALL.

Members present:     Mooney, Adamson, Neighbor, Golden, Nesteby
 Preussner, Techau, Seidl (6:02)   
Members Absent:     Olson
 
Seidl arrived 6:02 PM
 
3.                  MINUTES -

a.                  Planning and Zoning – November 9 and 30, 2004
b.                  Zoning Board of Adjustment – No November Meeting
c.                  City Council – November 4 and 18, 2004
 
Motion by Mooney, seconded by Nesteby to approve the November 9 and 30, 2004 minutes as submitted.
 
All “ayes” motion carried.

4.                  REZONING -

a.                  Public Hearing regarding Hunters Ridge Development Co., L.C. / JPM Enterprises, Inc. request to rezone property located east of Winslow Road, south of Winslow Court, from R-2, Medium Density, Single-Family Residential to R-3, Two-Family Residential.
 
Chairman Seidl declared the public hearing open (6:06 P.M.)
 
Hockett presented the staff report regarding the proposed rezoning request to accommodate a proposed condominium development.  Hockett stated that the proposed rezoning is consistent with the Future Land Use Map of the Comprehensive plan and adjacent zoning.  He stated that staff recommends approval of the proposed request.
 
There were no additional comments for or against the proposed request.  The public hearing was closed (6:10 P.M.)

b.                  CPC Resolution No. 04-44 regarding Hunters Ridge Development Co., L.C. / JPM Enterprises, Inc. request to rezone property located east of Winslow Road, south of Winslow Court, from R-2, Medium Density, Single-Family Residential to R-3, Two-Family Residential. (Case #04-09)
 
Motion by Mooney, seconded by Nesteby to approve CPC Resolution No. 04-44 regarding Hunters Ridge Development Co., L.C. / JPM Enterprises, Inc. request to rezone property located east of Winslow Road, south of Winslow Court, from R-2, Medium Density, Single-Family Residential to R-3, Two-Family Residential.
 
Ayes:              Mooney, Adamson, Neighbor, Golden, Nesteby
Preussner, Techau, Seidl
Nays:              None
Abstain:          None
 
Motion carried (8-0)

5.                  ZONING CODE AMENDMENTS –
 
a.                  CPC Resolution No. 04-45 regarding amending Chapter 176.38 of the Marion Code of Ordinances regarding Major Streets.
 
Treharne presented the staff report regarding the proposed amendments to the Major Streets Ordinance and recommended approval of the proposed changes.
 
Mooney questioned the 35th Avenue right-of-way width.  He stated that Cedar Rapids required less right-of-way than Marion and would like to see it further explored.
 
Treharne stated that it is something that will be explored further as 35th Avenue develops.

There were no additional comments for or against the proposed amendment

Motion by Techau, seconded by Adamson to recommend approval of CPC Resolution No. 04-45 regarding amending Chapter 176.38 of the Marion Code of Ordinances regarding Major Streets.

Preussner, Techau, Seidl
Nays:              Mooney
Abstain:          None
 
Motion carried (7-1)

b.                  CPC Resolution No. 04-46 regarding amending Chapter 176.08 of the Marion Code of Ordinances deleting sanitary landfills as a conditional use in the A-1, Rural Restricted zoning district.
 
Treharne presented the staff report regarding the proposed amendment to the A-1 Rural Restricted zoning district as well as I-2, General Industrial zoning district regarding the deletion of Sanitary Landfills as a conditional use.  He stated that this amendment is proposed to avoid conflicts with the recently proposed Exclusive Use Zoning District recently approved by the Commission and currently being reviewed by the City Council.
 
There were no comments for or against the proposed amendment.
 
Motion by Nesteby, seconded by Preussner to recommend approval of CPC Resolution No. 04-46 regarding amending Chapter 176.08 of the Marion Code of Ordinances deleting sanitary landfills as a conditional use in the A-1, Rural Restricted zoning district.
 
Ayes:              Adamson, Neighbor, Golden, Nesteby
Preussner, Techau, Seidl, Mooney
Nays:              None
Abstain:          None
 
Motion carried (8-0)
 
c.                  CPC Resolution No. 04-47 regarding amending Chapter 176.27 of the Marion Code of Ordinances deleting Sanitary Landfills as a conditional use in the I-2, General Industrial zoning district.

There were no comments for or against the proposed amendment.

6.                  OTHER BUSINESS.

There was no additional business to come before the Planning and Zoning Commission.
