MARION PLANNING AND ZONING COMMISSION
DECEMBER 13, 2005
1. CALL TO ORDER.
Chairman Seidl called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 PM.
2. ROLL CALL.
Members Present: Nesteby, Neighbor, Olson, Golden, Mooney, Seidl, Techau
Members Absent: Krigbaum, Preussner
Staff Present: Hockett, Treharne, Steigerwaldt
3. MINUTES -
a. Planning and Zoning – November 8, 2005
b. Zoning Board of Adjustment – No November Meeting
c. City Council – November 3 and 17, 2005
Motion by Golden, seconded by Mooney to approve the November 8, 2005 minutes, subject to Olson and Nesteby being recognized as present.
All “ayes” motion carried.
4. REZONING -
a. Public hearing regarding Katherine E. Kloubec et al request to rezone property located east of Mulberry Drive, north of East Robins Road from Linn County “A” to R-2, Medium Density, Single-Family Residential
Chairman Seidl declared the public hearing open at 6:06 PM
Hockett presented the staff report regarding the proposed rezoning request. Hockett stated that the proposed R-2, Medium Density Single-Family zoning request was consistent with the approved Future Land Use Map and compatible with the adjacent zoning and land uses. He stated that staff recommended approval of the proposed request.
Seidl inquired about the ability of sewer service to the development. Hockett indicated that sewer is currently located along the creek through the property and extends to the Linn-Mar elementary school on Alburnett Road.
Dustin Kern, Arcon Development, stated that the proposed development will be opened up to multiple builders to ensure different housing products and are eager to continue to work with the City on other aspects of this development related to stormwater management.
There were no additional comments for or against the proposed rezoning request and the public hearing was closed 6:18 PM.
b. CPC Resolution No. 05-36 regarding Katherine E. Kloubec et al request to rezone property located east of Mulberry Drive, north of East Robins Road from Linn County “A” to R-2, Medium Density, Single-Family Residential. (Case #05-13)
Motion by Mooney, seconded by Neighbor to recommend approval of CPC Resolution No. 05-36 regarding Katherine E. Kloubec et al request to rezone property located east of Mulberry Drive, north of East Robins Road from Linn County “A” to R-2, Medium Density, Single-Family Residential.
All “ayes” motion carried.
5. PLATS -
a. CPC Resolution No. 05-37 regarding Highview Addition Preliminary Plat located east of Mulberry Drive, north of East Robins Road (83 lots). (Case # 05-7).
Hockett presented the staff report regarding the proposed preliminary plat. Hockett stated that the lots would be for single family homes. He stated that sewer and water service is immediately available to the property and adequate to serve the entire development. Hockett stated that as proposed, the developer would be extending a single street to the north to tie into the proposed 35th Avenue (Tower Terrace Road).
Dustin Kern, Arcon Development, stated that the proposed development would be open to multiple builders to ensure different housing styles.
Mooney inquired why the southern thru street does not end in a
cul-de-sac. He stated that by creating the thru street the developer is only allowing the adjacent property owner use of one side of the road, as the south side abuts an existing lot.
Mr. Kern explained that a cul-de-sac would result in the loss of a lot, which was not the worse situation, but would result in some lots becoming more shallow and difficult to build on with the anticipated housing types. He stated, however, that they were not against the idea of exploring a
cul-de-sac option.
Jay Quimby, 3351 Mulberry Drive, stated support for the construction of the detention pond.
There were no additional public comments for or against the proposed preliminary plat
Motion by Techau, seconded by Golden to recommend approval of CPC Resolution No. 05-37 regarding Highview Addition Preliminary Plat located east of Mulberry Drive, north of East Robins Road subject to the following the condition that the proposed “Antrim Way” be platted as a cul-de-sac with the option of a thru street if the developer can obtain written consent from the adjacent property owner to construct a thru street prior to final platting.
All “ayes” motion carried.
b. CPC Resolution No. 05-38 regarding Creekview Addition Final Plat and Final Cluster Plan located between the abandoned railroad right-of-way and Indian Creek, west of Grand Avenue (36 lots). (Case #0577
Hockett presented the staff report regarding the proposed Creekview Addition Final Plat and Final Custer Plan. Hockett explained that the final plat and final cluster plan were consistent with the approved preliminary plat and recommend approval of the proposed addition.
There was no public comment for or against the proposed final plat and final cluster plan.
Motion by Mooney, seconded by Golden to recommend approval of CPC Resolution No. 05-38 regarding Creekview Addition Final Plat and Final Cluster Plan located between the abandoned railroad right-of-way and Indian Creek, west of Grand Avenue.
All “ayes” motion carried.
6. OTHER BUSINESS.
a. CPC Resolution No. 05-39 amending the Marion Planning and Zoning Commission By-Laws.
Hockett reviewed Planning and Zoning Commission voting procedures as stated in the By-Laws and noted the changes, most notably the meeting time.
Motion by Olsen, seconded by Golden to approve CPC Resolution No. 05-39 amending the Marion Planning and Zoning Commission By-Laws.
All “ayes” motion carried.
7. ADJOURN.
There being no additional business to come before the Marion Planning and Zoning Commission, the meeting was adjourned at 7:35 PM.
