MINUTES
PLANNING AND ZONING COMMISSION
MARCH 14, 2006

1. CALL TO ORDER.

Chairman Nesteby called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 P.M.

2. ROLL CALL.

Members Present: Mooney, Nesteby, Preussner, Siedl, Golden, Techau,
Members Absent: Krigbaum, Olson, Neighbor

3. MINUTES -

a. Planning and Zoning – February, 2006
b. Zoning Board of Adjustment – February 21, 2006
c. Council – February 2 and 16, 2006

Motion by Mooney, seconded by Preussner to recommend approval of the minutes from the February 14, 2006 Planning and Zoning Commission meeting as submitted.

4. REZONINGS -

a. Public hearing regarding F.S. Investment (Mr. Beans) request to rezone property located at 1080 East Post Road from C-1, Neighborhood Commercial to C-3, General Commercial

Hockett presented the staff report regarding the proposed rezoning request.  Hockett stated that the request to rezone the property is consistent with the Future Land Use Map; however, because of the adjacent residential property to the west Staff recommends the following conditions.

1. No outdoor patio on the west side of the building.
2. Limit hours of operation from 6:00 A.M. to 11:00 P.M.
3. No outdoor signs regarding liquor sales.

Brent Miller, 1201 Valley Park Street, inquired to timing of installation of landscaping required along the rear of the property.

Hockett stated that landscaping was required as part of the building permit.  Landscaping will be required to be installed prior the building being issued a Final Certificate of Occupancy.

Amy Bean, representing the applicant, stated that this rezoning is to accommodate a coffee shop that also serves soups and sandwiches and would like to offer wine and limited beers as an option to their customer’s.  She stated that the restaurant would have bar associated with it.  She stated that the south side of Marion has limited commercial and this would be the first restaurant in the area and would be a much needed asset in the area. 
There were no additional comments for or against the proposed request and the public hearing was closed.

b. CPC Resolution No. 06-04 regarding F.S. Investment (Mr. Beans) request to rezone property located at 1080 East Post Road from C-1, Neighborhood Commercial to C-3, General Commercial. (Case #06-02)

Motion by Techau, seconded by Mooney to recommend approval of CPC Resolution No. 06-04 regarding F.S. Investment (Mr. Beans) request to rezone property located at 1080 East Post Road from C-1, Neighborhood Commercial to C-3, General Commercial subject to the following:

1. No outdoor patio on the west side of the building.
2. Limit hours of operation from 6:00 A.M. to 11:00 P.M.

All “ayes” motion carried.

a. Public hearing regarding Gerald Blazek request to rezoning property located at 600 10th Avenue (Community Center) from R-2, Medium Density, Single-Family Residential and R-3, Two-Family Residential to RT-1, Residential Transitional.

Hockett presented the staff report regarding the proposed rezoning.  Hockett stated that the current designation of civic uses is compatible with the RT-1, Residential Transitional zoning which is to allow an acceptable range of land uses and controls for the reuse of vacant school and institutional properties in residential neighborhoods.  The permitted uses are limited to low intensity office and service uses characterized by low traffic generation with little or no customer contact on the premises.  Hockett reviewed a brief summary of permitted and conditional uses of the RT-1 zoning district.  He stated that staff recommends approval of the proposed request.

Jerry Blazek, 684 8th Avenue, indicated that he would like to save the building as it is an important asset to the community.  He stated that the use would remain similar to its current use as a community center type institution.

Steve Sprague, 999 7th Street, indicated that he was not opposed to the rezoning of the property, but wanted to make sure adequate off-street parking was made available for any intended use and that hours of operation be limited as the property is located within a residential area.

There being no additional comments for or against the proposed request the public hearing was closed.

b. CPC Resolution No. 06-05 regarding Gerald Blazek request to rezoning property located at 600 10th Avenue (Community Center) from R-2, Medium Density, Single-Family Residential and R-3, Two-Family Residential to RT-1, Residential Transitional.  (Case No. 06-01)

Motion by Seidl, seconded by Mooney to recommend approval of CPC Resolution No. 06-05 regarding Gerald Blazek request to rezoning property located at 600 10th Avenue (Community Center) from R-2, Medium Density, Single-Family Residential and R-3, Two-Family Residential to RT-1, Residential Transitional subject to the following conditions:

1. Off-street parking be adequate to accommodate any potential reuse of the property.
2. Hours of operation be limited to 6:00 A.M. to 10:00 P.M.
3. No pole signs shall be permitted on the property.

 All “ayes” motion carried.

3. PLATS -

a. CPC Resolution No. 06-06 regarding Oakbrook Second Addition – Final Plat located at the northwest corner of East Post Road and Highway 100.  (Case #06-52)

Hockett presented the staff report regarding the proposed final plat for property.  Hockett stated that this final plat is considered a minor subdivision and does not require a preliminary plat for review prior to the final plat.  Hockett stated that the proposed request meets the Marion Subdivision Regulations.

Motion by Seidl, seconded by Preussner to recommend approval of CPC Resolution No. 06-06 regarding Oakbrook Second Addition – Final Plat located at the northwest corner of East Post Road and Highway 100. 

All “ayes” motion carried.

b. CPC Resolution No. 06-07 regarding Gary Holub - Preliminary Site Development Plan, Parcel A, Plat of Survey #823 located at the northeast corner of 35th Street and Munier Road.  (Case #06-53)

Hockett presented the staff report for both the proposed preliminary and final site development plan.  Hockett stated that the property has been rezoned several times in the past 10 years and the current PD-S district has one condition placed on the property that restricts commercial use on the west one-fourth of the property and residential on the east three-fourths of the property.  The proposal is for a single family home and a detached garage approximately 40’ x 100’ along the west property line.  Hockett stated that a landscape buffer shall be required to minimize the impact of the large garage.

Dan Schmidt, Brain Engineering representing the applicant, stated that the garage would have a bathroom and would have 10 foot doors.  He stated that the garage of this size is required to hold the applicant’s car collection.

Ray Rieniets, 320 Antler Court, expressed some concern about drainage along the rear of the properties but was supportive of the applicant’s request.

Mooney inquired as to the appearance of the proposed garage.

Schmidt submitted photos of what the applicant is proposing which showed a steel garage with steel roof and several overhead doors.

Mooney expressed concern about a metal garage of this size immediately behind the homes on Antler Court.  He questioned why the garage and house could not be switched so that the house backs up to the homes on Antler Court.

Lorna Rieniets, 320 Antler Court, stated that she was not opposed to the project, but would like to see the two structures switched.

There was further discussion between Commission members regarding appearance of the proposed garage.

Mooney requested that Schmidt show what the two structures would look like switched.

Dan Schmidt prepared a sketch drawing of what the proposed revision would look like.

Motion by Siedl, seconded by Mooney to recommend approval of CPC Resolution No. 06-07 regarding Gary Holub - Preliminary Site Development Plan, Parcel A, Plat of Survey #823 located at the northeast corner of 35th Street and Munier Road.  Subject to the following:

1. Relocation of the garage to the house location and the house to the garage location.
2. Landscaping shall be provided along the east lot line.

 All “ayes” motion carried.

c. CPC Resolution No. 06-08 regarding Gary Holub - Final Site Development Plan, Parcel A, Plat of Survey #823 located at the northeast corner of 35th Street and Munier Road.  (Case #06-54)

Motion by Siedl, seconded by Golden to recommend approval of CPC Resolution No. 06-08 regarding Gary Holub – Final Site Development Plan, Parcel A, Plat of Survey #823 located at the northeast corner of 35th Street and Munier Road.  Subject to the following:

1. Relocation of the garage to the house location and the house to the garage location.

2. Landscaping shall be provided along the east lot line.

 All “ayes” motion carried.

a. CPC Resolution No. 06-09 regarding The Coves at English Glen First Addition – Final Plat and Final Site Development Plan located.  (Case #06-55)

Hockett presented the staff report for the proposed final plat.  Hockett stated that the plat was consistent with the approved preliminary plat and recommended approval of the plat.

There were no questions or comments for or against the proposed request.

Motion by Mooney, seconded by Siedl to recommend approval of CPC Resolution No. 06-09 regarding The Coves at English Glen First Addition – Final Plat and Final Site Development Plan. 

All “ayes” motion carried.

3. OTHER BUSINESS.

There was no additional business to come before the Planning and Zoning Commission.

4. ADJOURN.

There being no additional business to come before the Board, the monthly meeting of the Marion Planning and Zoning Commission was adjourned at 8:32 P.M.
