MINUTES
PLANNING AND ZONING COMMISSION
MAY 9, 2006

1. CALL TO ORDER.

Vice-Chairman Seidl called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 PM.

2. ROLL CALL.

Members Present: Mooney, Neighbor, Seidl, Preussner, Golden, Techau
Members Absent: Olson, Krigbaum, Nesteby
Staff Present:          Treharne, Planning & Development Director
                                 Hockett, Assistant Planning & Development Director

3. MINUTES -

a. Planning and Zoning – April 11, 2006
b. Zoning Board of Adjustment – April 18, 2006
c. Council – April 6 and 20, 2006

Motion by Mooney to recommend approval of the April 11, 2006 Planning and Zoning Commission minutes as submitted, seconded by Neighbor.

All “ayes” motion carried

4. COMPREHENSIVE PLAN AMENDMENT -

a. Public hearing regarding a proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan to change the designation for property located south of Tower Terrace Road west of 35th Street in Marion, Linn County, Iowa from “Office/High-Intensity Mixed Use” to “Urban Residential”.

Hockett presented the staff report regarding the proposed future land use amendment.  Hockett stated that the amendment as proposed was consistent with existing and proposed land uses.  Staff recommends approval of the request as submitted.

Jim Dalton, 3492 Quail Trail Court, inquired as to phasing of construction of the project in regards to the completion of 35th Street.

Hockett indicated that 35th Street will be completed in several phases by several different developers and the completed connection to Tower Terrace Road will be years away.

There were no additional questions for or against the future land use amendment.

The public hearing was closed.

b. CPC Resolution No. 06-11 regarding proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan to change the designation for property located south of Tower Terrace Road west of 35th Street in Marion, Linn County, Iowa from “Office/High-Intensity Mixed Use” to “Urban Residential”.  (Morris Wood, LLC)

Motion by Mooney, seconded by Preussner, to recommend approval of CPC Resolution No. 06-11 regarding the proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan to change the designation for property located south of Tower Terrace Road west of 35th Street.

All “ayes” motion carried.

5. REZONINGS -

a. Public Hearing regarding a requests to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to R-2, Medium Density Single-Family Residential, R-4, Four-Family Residential and PD-C, Planned Development – Commercial.

Hockett presented the staff report regarding the proposed rezonings. Hockett stated that the proposed rezonings were consistent with adjacent zoning classification and land uses and were consistent with the Marion Future Land Use map.

There were no public comments for or against the proposed request.

The public hearing was closed.

b. CPC Resolution No. 06-12 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to R-2, Medium Density Single-Family Residential (Morris Wood, LLC).  (Case# 06-04)

Motion by Golden, seconded by Techau to recommend approval of CPC Resolution No. 06-12 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to R-2, Medium Density Single-Family Residential (Morris Wood, LLC). 

All “ayes” motion carried.

c. CPC Resolution No. 06-13 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to R-4, Four-Family Residential (Morris Wood, LLC).  (Case# 06-04)

Motion by Mooney, seconded by Golden to recommend approval of CPC Resolution No. 06-13 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to R-4, Four-Family Residential (Morris Wood, LLC) subject to the following condition(s):

1. Rezoning shall be subject to Section 176.43 Landscaping and Screening Standards.

All “ayes” motion carried.

d. CPC Resolution No. 06-14 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to PD-C, Planned Development – Commercial (Morris Wood, LLC).  (Case# 06-05)

Motion by Golden, seconded by Mooney to recommend approval of CPC Resolution No. 06-14 regarding a request to rezone property located south of Tower Terrace Road, west of 35th Street in Marion, Linn County, Iowa from A-1, Rural Restricted to PD-C, Planned Development – Commercial (Morris Wood, LLC) subject to the following condition(s):

1. All buildings should be constructed with pitched/gabled roofs and exterior material made of brick, stone, stucco or concrete block – excluding the requirement for pitched / gabled roofs on buildings over 10,000 square feet.
2. Dumpsters and reclamation areas shall be directed away from the residentially zoned property and major street corridors and shall be screened and buffered.
3. To maintain the aesthetic quality of the proposed residential neighborhood, all signage shall be ground or wall mounted, and the use of pole signs shall be prohibited.
4. The commercial property shall be subject to Section 176.43 Landscaping and Screening Standards.
5. All setback requirements in the PD-C district shall be consistent with the Sketch Plat – setbacks along Tower Terrace Road shall be 30 feet.
6. Uses shall be limited to the permitted uses identified in the C-1 and C-2 zoning district, while including Drive-in or Drive through restaurants and gas stations selling fuel, lubricants, coolants, and other commodities but not including the performance of vehicle repair and maintenance of any kind as permitted uses.

  All “ayes” motion carried

6. ADJOURN.

There being no additional business to come before the Marion Planning and Zoning Commission the meeting was adjourned at 6:53 PM.
