MINUTES
PLANNING AND ZONING COMMISSION
AUGUST 8, 2006

1. CALL TO ORDER.

Nesteby called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00PM

2. ROLL CALL.
Members Present: Mooney, Preussner, Techau, Seidl, Golden, Neighbor, Nesteby
Members Absent: Krigbaum, Olson,
Staff Present: Hockett, Treharne

3. MINUTES -

a. Planning and Zoning –July 11, 2006
b. Zoning Board of Adjustment – No July Meeting
c. Council – July 6 and 20, 2006

Motion by Mooney, seconded by Preussner to approve the July 11, 2006 Planning and Zoning Commission as submitted.

4. REZONINGS -

Hockett stated that the public hearing notice was not published correctly for the proposed rezoning request and stated that the public hearings could be held, but no action should be taken on the requests.

a. Public Hearing regarding requests to rezone properties located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted to 0-2, Office-Park (Parcel C and D).  (City of Marion/Anace Aossey/Armstrong Development Company).

Nesteby declared the public hearing regarding the rezoning requests opened.

There were no public comments for or against the proposed requests.

The public hearing was closed.

Hockett stated that the public hearing notice would be republished and a public hearing would be scheduled for the September 12, 2006 Planning and Zoning Commission meeting.

b. CPC Resolution No. 06-21 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted to 0-2, Office-Park (Parcel C).  (City of Marion / Armstrong Development Company).  (Case #06-06)

c. CPC Resolution No. 06-22 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted to 0-2, Office Park (Parcel D) (Anace Aossey / Armstrong Development Company).  (Case #06-07)

5. COMPREHENSIVE PLAN AMENDMENT -

a. Public Hearing regarding an amendment to the Transportation Map of the Marion Comprehensive Plan regarding 31st Street alignment between 29th Avenue and Tower Terrace Road (formerly 35th Avenue)

Chairman Nesteby opened the public hearing regarding the proposed amendment.

Hockett presented the staff report regarding the proposed amendment to the Future Land Use Map.  Hockett stated that the preliminary plat for the area was approved last month without the 31st Street connection to Tower Terrace being shown.

There were no public comments for or against the proposed request

The public hearing was closed.

b. CPC Resolution No. 06-23 regarding an amendment to the Transportation Map of the Marion Comprehensive Plan regarding the 31st Street alignment between 29th Avenue and Tower Terrace Road (formerly 35th Avenue).

Motion by Mooney, seconded by Techau, to recommend approval of CPC Resolution No. 06-23 regarding an amendment to the Transportation Map of the Marion Comprehensive Plan regarding 31st Street alignment between 29th Avenue and Tower Terrace Road (formerly 35th Avenue).

6. PLATS -

a. CPC Resolution No. 06-24 regarding Oakbrook Third Addition -Final Plat, located north of Highway 100, west of Menard Lane.  (Menard, Inc.) (Case# 06-69)

Hockett presented the staff report regarding the Oakbrook Third Addition final plat.  Hockett stated that this split was similar to what was done on the Second Addition and was being done to accommodate a commercial development.

There were no public comments for or against the proposed request.

Motion by Mooney, seconded by Preussner to recommend approval of CPC Resolution No. 06-24 regarding Oakbrook Third Addition -Final Plat, located north of Highway 100, west of Menard Lane.  (Menard, Inc.)

7. OTHER BUSINESS.

a. Capital Improvements Program Update.

b. Planning Activity Update.

Treharne presented an update to the Capital Improvements Program and planning activities. 

8. ADJOURN.

There being no further business to come before the Planning and Zoning Commission the meeting was adjourned at 6:45 PM.
