Planning and Zoning Commission
November 13, 2007

1. CALL TO ORDER.

The regular monthly meeting of the Marion Planning and Zoning Commission was called to order at 6:00 PM by Vice-Chairman Mooney.

2. ROLL CALL.

Members Present: Golden, Preussner, Mooney, Krigbaum, Moomey, Siedel,
                                         Neighbor
Members Absent: AbouAssaly, Nesteby
Staff Present:  Treharne, Hockett and Kaiser

3. MINUTES -

a. Planning and Zoning – October 9, 2007
b. Zoning Board of Adjustment – October 16, 2007
c. Council – October 4 and 18, 2007

Motion by Golden, seconded by Preussner to approve the minutes of the October 9, 2007 Planning and Zoning Commission meeting as submitted.

All “ayes” motion carried.

4. REZONING -

a. CPC Resolution No. 07-31 regarding Robin Holub request to rezone property located east of 31st Street, north of Munier Road from A-1, Rural Restricted to PD-C, Planned Development –Commercial.   (Case #07-04)

Hockett presented the staff report regarding the proposed rezoning that was tabled at the previous meeting.  Hockett stated that the request was modified to PD-C, Planned Development Commercial based on concerns that were expressed by the Commission at the previous meeting. 

Hockett explained that the conditions on the rezoning limit the types of uses permitted on the site to uses typically found in the C-2, Downtown Commercial District, including some uses related to storage typically associated with C-3, General Commercial zoning. He stated that redevelopment standards recommended are similar to conditions placed on previous PD-C requests regarding building and site design.

Hockett also presented both the Preliminary and Final Site Development Plans for the area indicating that they reflect how the property appears today.  He stated that if future redevelopment were to occur the applicant / owner would have to submit a revised preliminary and final site development plan that would be brought back to the Planning and Zoning Commission for recommendation to the City Council and would have to meet the conditions proposed for the rezoning of the property.

Scott Peterson, 425 2nd Street SE Suite 1000, Cedar Rapids Iowa representing the applicant indicated that they were supportive of the request including the use limitations and conditions related to design standards for future redevelopment of the property.

Motion by Golden, seconded by Preussner to recommend approval of CPC Resolution No. 07-31 regarding Robin Holub request to rezone property located east of 31st Street, north of Munier Road from A-1, Rural Restricted to PD-C, Planned Development –Commercial, subject to the following:

1. Architectural Requirements.  Shall apply to any new construction on the parcel.
a. The use of brick, stone, stucco or concrete block shall be used on all sides of all buildings in order to enhance the physical appearance of the building and attempt to make the structure more compatible with the residential structures in the adjacent neighborhood. 

b. The roof design of all future buildings under 10,000 square feet shall be pitched or gabled in attempt to make the structure more compatible with the residential structures in the adjacent neighborhood.

2. Landscaping and Buffering.
a. Any redevelopment of the property shall be subject to landscaping and screening requirements established by the City of Marion Zoning Ordinance.   Landscaping plans as part of redevelopment shall be reviewed and approved during the site planning stage of the redevelopment.

3. Signage.
a. No pole signage as defined by the City of Marion Zoning Ordinance shall be incorporated into any portion of the property zoned C-3.

b. All ground/shopping center signs shall not exceed ten feet (10’) in height from grade.

c. No Wall signs shall exceed 1/5 of the wall area to which it is attached.

d. Channel lettered wall signs shall be permitted to cover 2/5 of the wall area to which it is attached.

e. No electronic message boards shall be permitted.

4. Permitted Uses – The following principal uses are permitted:
a. Retail business which supply commodities on the premises and are permitted in the C-2 District.

b. Personal service establishments permitted in the C-2 District.

c. Professional office establishment permitted in the C-2 Districts.

d. Public, quasi-public and governmental buildings and facilities permitted in the C-2 District except Day care Centers.

e. Wholesale and warehouse uses permitted in the C-3 District.

5. Conditional Uses – The following uses are permitted only when authorized by the Zoning Board of Adjustment
a. Water Softener Sales and Services

b. Outside Storage

6. Similar and compatible uses to those allowed as principal or conditional uses.

All “ayes” motion carried.

5. PRELIMINARY AND FINAL SITE DEVELOPMENT PLAN -

a. CPC Resolution No. 07-32 regarding Robin Holub - Preliminary Site Development Plan for property located east of 31st Street, north of Munier Road.  (Case # 07-04)

Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 07-32 regarding Robin Holub Preliminary Site Development Plan for property located east of 31st Street, north of Munier Road.

All “ayes” motion carried.

b. CPC Resolution No. 07-33 regarding Robin Holub Final Site Development Plan for property located east of 31st Street, north of Munier Road.  (Case #07-04)

Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 07-33 regarding Robin Holub Final Site Development Plan for property located east of 31st Street, north of Munier Road.

All “ayes” motion carried.

6. PLATS -

a. CPC Resolution No. 07-34 regarding Mormann First Addition to Linn County – Final Plat for property located east of Highway 13, north of Tower View Road.  (Case #07-66).

Kaiser presented the staff report regarding the proposed County split indicating that it was located outside of the Future Land Use Map area, but within 2 miles of the City’s review jurisdiction.   She stated staff had no objections to permitting the split subject to an agreement to annex at the time the property became adjacent to Marion City limits.

There were no additional comments for or against the proposed final plat.

It was noted by the Commission that neither the applicant nor the applicants engineer was present to address any comments the Commission may have regarding the proposed plat.

Motion by Mooney, seconded by Preussner to recommend approval of CPC Resolution No. 07-34 regarding Mormann First Addition to Linn County Final Plat for property located east of Highway 13, north of Tower View Road.

Roll Call Vote requested:

“Ayes” (Approving) – Golden, Mooney, Moomey, Preussner
“Nays” (Denying) – Seidl, Neighbor, Krigbaum

Motion approved (4-3).

7. OTHER BUSINESS

a. Public hearing regarding an amendment to Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conversion systems.

Kaiser presented the staff report regarding the proposed wind energy conversion systems and stated that little had changed from previous drafts of the ordinance other than additional height regulations and the removal of residential systems from residential districts.

There was no public comment for or against the proposed amendment.

b. CPC Resolution No. 07-35 regarding an amendment to Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conversion systems.

Motion by Krigbaum, seconded by Neighbor to recommend approval of CPC Resolution No. 07-35 regarding an amendment to Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conversion systems.

All “ayes” motion carried.

c. Public Hearing regarding an amendment to the Winslow Road Urban Renewal Area and the Urban Renewal Plan.

Treharne presented the staff report regarding the proposed map and plan amendment and explained how the Urban Renewal plan can be used.

Mooney inquired why the boundaries were not extended to include property within the more recently platted areas along both Lucore Road and Winslow Road.

Treharne explained that if the Commission wished, they could recommend an alternative map to include those areas.

There were no additional comments for or against the proposed amendment to the Urban Renewal Area.

d. CPC Resolution No. 07-36 regarding amendment to the Winslow Road Urban Renewal Area and the Urban Renewal Plan.

Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 07-36 regarding an amendment to the Winslow Road Urban Renewal Area and the Urban Renewal Plan subject to the Glen Rock Farms, Huntington Hills, Champions Estates, Camden Farms, Hunters Creek and Hunters Field Additions being included within the boundaries

All “ayes” motion carried.

8. ADJOURN.

There being no additional business to come before the Commission, the meeting was adjourned at 8:17 PM.
