The Honorable Fae Hoover-Grinde, District Court Judge, administered the Oath of Office to Mayor Paul Rehn.

The Honorable Fae Hoover-Grinde, District Court Judge, administered the Oath of Office to Ward Three Council Member Kay Lammers.

The Honorable Fae Hoover-Grinde, District Court Judge, administered the Oath of Office to Ward One Council Member Steve Sprague.

The Honorable Fae Hoover-Grinde, District Court Judge, administered the Oath of Office to At-Large Council Member Nick Glew.

The City Council of the City of Marion, Linn County, Iowa met in regular session, Thursday, January 10, 2008, at 7:00 p.m. in the council chambers of City Hall with Mayor Rehn presiding and the following council members present:  Sprague, Adamson, Lammers, Pazour, and Glew.  Absent:  None.

The meeting was opened with the Pledge of Allegiance.

Mayor Rehn administered the Oath of Office to Patrol Officer Mitchell Walser.

Council Member Pazour requested that Resolution No. 19718, setting hearing for February 21, 2008 related to tobacco violation (Hy-Vee Drugstore, 2790 7th Avenue – Dan Strait, Store Director) be amended to set the date of hearing for January 17, 2008. 

Moved by Adamson, seconded by Lammers to approve the Consent Calendar, including the amendment to Resolution No. 19718, as follows:

 

Resolution No. 19712 setting public hearing for February 7, 2008 regarding request to rezone property located at 211 13th Street from C-4, Warehouse/ Commercial to R-3, Two-Family Residential (Frank Reynolds request).

Resolution No. 19713 approving final reimbursement payment to Arcon Development, Inc. per agreement regarding the Dry Creek Regional Detention Basin Project in the amount of $70,242.84.

Resolution No. 19714 approving the installation of a stop sign east bound on REC Drive at Highway 13.

Motion to approve Project Calendar regarding acceptance of certain public improvements, as follows:

a.      Resolution No. 19715 accepting the public improvements for Linn Meadows First Addition to the City of Marion.

b.      Resolution No. 19716 accepting the remaining public improvements for the Coves First Addition to the City of Marion.

Motion directing staff to solicit bids for a one-half ton pick-up truck for Engineering Department.

Motion to receive and file report regarding curb machine.

Motion to approve the minutes of the December 18 and 20, 2007 City Council meetings.

Motion to approve bills as presented in the amount of $686,956.00.  

Resolution No. 19717 approving renewal application for a Class C Beer permit with additional privilege for Sunday Sales for Murphy Oil USA, Inc. dba Murphy Oil USA #7287.

Motion to receive and file request for hearing related to tobacco violation (Hy-Vee Drugstore, 2790 7th Avenue – Dan Strait, Store Director).

Resolution No. 19718 setting hearing for January 17, 2008 related to tobacco violation (Hy-Vee Drugstore, 2790 7th Avenue – Dan Strait, Store Director).

Resolution No. 19719 setting hearing for February 7, 2008 regarding liquor license suspension (VIP Lounge).

Motion to receive and file letter of resignation from Civil Service Commissioner Cornie Bender effective January 1, 2008.

All in favor of motion to approve the consent calendar, motion carried.

Ordinance No. 07-17 amending the Marion Code of Ordinances regarding a request to rezone property located at the northeast corner of 31st Street and Munier Road from A-1, Rural Restricted to R-2, Medium Density, Single-Family Residential (Robin J. Holub request) was read by Lammers for second consideration.  Moved by Lammers, seconded by Pazour to approve the second reading of Ord. No. 07-17.  All in favor except Adamson, motion carried.

Ordinance No. 07-19 amending the Marion Code of Ordinances regarding a request to rezone property located at the northeast corner of 31st Street and Munier Road from A-1, Rural Restricted to C-4, Warehouse/Commercial (Robin J. Holub request) was read by Pazour for second consideration.  Moved by Pazour, seconded by Lammers to approve the second reading of Ord. No. 07-19.  All in favor except Adamson, motion carried.

Ordinance No. 07-32 amending the Marion Code of Ordinances regarding a request to rezone property located east of 31st Street, north of Munier Road from A-1, Rural Restricted to PD-C, Planned Development – Commercial (Robin Holub request) was read by Glew for second consideration.  Moved by Glew, seconded by Pazour to approve the second reading of Ord. No. 07-32.  All in favor except Sprague and Adamson, motion carried.

Ordinance No. 07-33 amending Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conservation systems was read by Sprague for second consideration.  Moved by Sprague, seconded by Adamson to approve the second reading of Ord. No. 07-33.  All in favor, motion carried.

Resolution No. 19720 approving the Memorandum of Agreement and Final Plat of Yoder First Addition to Linn County, located north of Big Springs Road, west of Hindman Road (Darrell Loan) was read by Adamson.  Moved by Adamson, seconded by Pazour to approve. Res. No. 19720.  All in favor, motion carried.

Ordinance No. 07-34 amending Chapter 120 of the Code of Ordinances and prohibiting boxing, wrestling, martial arts fighting or similar contests in establishments holding liquor licenses and/or wine or beer and providing penalties was read by Lammers for second consideration.  Moved by Lammers, seconded by Pazour to approve the second reading of Ord. No. 07-34.  All in favor, motion carried.

Ordinance No. 08-01 amending Chapter 40 relating to disorderly houses was read by Pazour for initial consideration.  Moved by Pazour, seconded by Adamson to approve the first reading of Ord. No. 08-01.  Police Chief Harry Daugherty presented the staff report. All in favor, motion carried.

Mayor Rehn recommended the appointment of Council Member Kay Lammers as Mayor pro tem and Council Member Mary Lou Pazour as Deputy Mayor pro tem.  Moved by Glew, seconded by Adamson to concur with Mayor Rehn’s recommendation.  All in favor, motion carried.

Moved by Lammers, seconded by Pazour to concur with the Mayor’s recommendation.  All in favor, motion carried.

Council Discussion:
         Council Member Glew thanked the snow plow drivers for all their work during the holidays.  He asked if the City of Marion would be applying for federal funds.  Public Services Director Tom Newbanks replied that he will be applying for reimbursement from FEMA.
         Council Member Pazour asked if the City allowed residents one extra bag of garbage the week after Christmas.  Mayor Rehn stated that the extra bag was allowed.  He noted that there was an article in the paper regarding the extra bag pickup.
         Council Member Pazour congratulated the Marion High School on fifty years of wrestling. 
         Council Member Adamson congratulated the newly elected officials.  He also thanked the citizens that volunteer to serve on the Boards and Commissions. 
         Mayor Rehn thanked the Public Services Department for the great job they have done plowing snow this winter.  Mayor Rehn also thanked Judge Hoover-Grinde for administering the Oaths tonight.  Mayor Rehn noted that the State of the City address will be Monday, January 28th at 11:45 a.m.  Mayor Rehn invited the public to attend the Council meetings.  He noted that Council will interview two candidates for the vacant Ward Two Council Member position at the January 17th Council meeting. 

Mayor Rehn adjourned the meeting at 7:35 p.m.
