MINUTES
PLANNING AND ZONING COMMISSION
FEBRUARY 8, 2005

1. CALL TO ORDER.

Vice-Chairman Mooney called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 P.M.

2. ROLL CALL.

Members Present: Mooney, Golden, Adamson, Techau, Neighbor, Seidl
(late), Nesteby
Members Absent: Preussner, Olson
Staff Present:  Treharne, Hockett, Steigerwaldt

3. MINUTES -

a. Planning and Zoning – January 11, 2005
b. Zoning Board of Adjustment –No Meeting
c. City Council – January 6 and 20, 2005.

Motion by Golden, seconded by Techau to approve the minutes as submitted.

All “ayes” motion carried.

Seidl stated that he would remove himself from discussion regarding the proposed rezoning CPC Resolution No. 05-03 and preliminary plat CPC Resolution No. 05-03 as he represents the Marion Churches Senior Living Foundation.

4. REZONINGS-

a. Public hearing regarding Wayne and Ann Scott, owner and Jane High, President of the Marion Churches Senior Living Foundation, contract purchaser, request to rezone property located east of Highway 13, south of Robinwood Lane from A-1, Rural Restricted to PD-R, Planned Development-Residential and Preliminary Site Development Plan.

Mooney declared the public hearing open.

Hockett presented the staff report regarding the proposed preliminary development plan.  Hockett stated that the proposed access to the development would be via Bison Court from the north and as development occurs to the east of this development a secondary access would be constructed on a future north/south street.  He stated the proposed development would consist of several more buildings for assisted living with the possibility of apartments and cluster housing to the north to buffer the existing homes form the denser housing product to the south

Hockett stated staff recommends approval of the proposed development subject to the following conditions:

1. Architectural Requirements:  Buildings should be constructed with pitched/gabled roofs and exterior material made of traditional siding, brick, stone, or block in order to enhance the physical appearance of the buildings and attempt to make the structures more compatible with the residential structures in the adjacent neighborhood.  Dumpsters and reclamation areas shall be directed away from the residentially zoned property and major street corridors and shall be screened and buffered.  In addition, to maintaining the aesthetic quality of the neighborhood, all signage should be ground or wall mounted, with the use of pole signs being prohibited.

2. Signage Requirements: All signage within the PD-R District shall be in accordance with the provisions of Chapter 176.31, Signs of the City of Marion Code of Ordinances unless otherwise specified below:

a. No pole signs, as defined by the City of Marion Zoning Ordinance shall be incorporate into any development within the PD-R District.  Grounds signs shall be used for construction of freestanding signage as set forth within the City of Marion Sign Ordinance.

3. Landscaping and Buffering:  All development within the PD-R District shall comply with Section 146.43 of Marion Code of Ordinances.

There were no comments for or against the proposed rezoning.  The public hearing was closed.

b. CPC Resolution No. 05-03 regarding Wayne and Ann Scott, owner and Jane High, President of the Marion Churches Senior Living Foundation, contract purchaser, request to rezone property located east of Highway 13, south of Robinwood Lane from A-1, Rural Restricted to PD-R, Planned Development-Residential and Preliminary Site Development Plan.

Motion by Techau, seconded by Golden to recommend approval of CPC Resolution No. 05-03 regarding Wayne and Ann Scott, owner and Jane High, President of the Marion Churches Senior Living Foundation, contract purchaser, request to rezone property located east of Highway 13, south of Robinwood Lane from A-1, Rural Restricted to PD-R, Planned Development-Residential and Preliminary Site Development Plan subject to staff conditions.

All “ayes”, motion carried (6-0-1)

5. PLATS -

a. CPC Resolution No. 05-04 regarding Marion Churches Second Addition to the City of Marion, Iowa, Preliminary Plat and Preliminary Site Development Plan located east of Highway 13, south of Robinwood Lane.  (Case #05-53)

Hockett presented the staff report regarding the proposed preliminary plat and preliminary site development plan. Hockett stated that all items discussed with the previous rezoning case apply to the preliminary plat and preliminary site development plan.

Steigerwaldt stated that the existing stormwater detention pond was designed for future development of this property and has been sized correctly.

Terry Chew, Anderson-Bogert Engineering representing the applicants stated that if there were any questions he was available.

Brent Hanna, 5885 Robbinwood Lane, inquired about the primary access to the development.  He stated that he was concerned about the amount of traffic that would be going through the area when this area to the south becomes fully developed.

Treharne stated that Bison Court would serve as the primary access to Highway 13 via Robinwood Lane and as development occurred to the east a secondary connection would be made from this development to the first north/south street.

Mrs. Hanna, 5885 Robbinwood Lane, asked if this plan had changed much from the original concept shown to them by the developer at the time they purchased their property.

Eldon McMillen, stated that the proposal is the same and no changes have occurred on the north end from the original concept that he presented to them.

There were no other questions or comments regarding the proposed preliminary plat and preliminary site development plan.

Motion by Adamson, seconded by Techau to recommend approval of CPC No. 05-04 regarding Marion Churches Second Addition to the City of Marion, Iowa, Preliminary Plat and Preliminary Site Development Plan located east of Highway 13, south of Robinwood Lane.

All “ayes” motion carried (6-0-1)

6. ZONING CODE AMENDMENT –

a. Public hearing regarding an amendment to Section 176.35, Supplemental Regulations of the Marion Code of Ordinances regarding frequency of garage/yard sales.

Hockett presented the proposed ordinance related to the frequency of garage sales permitted in a calendar year.

There were no questions for or against the proposed amendment to the Marion Code of Ordinances.  The public hearing was closed.

b. CPC Resolution No. 05-05 regarding an amendment to Section 176.35, Supplemental Regulations of the Marion Code of Ordinances regarding frequency of garage/yard sales.

Motion by Techau, seconded by Golden to recommend approval of CPC Resolution No. 05-05 regarding an amendment to Section 176.35, Supplemental Regulations of the Marion Code of Ordinances regarding frequency of garage/yard sales.

All “ayes” motion carried.

7. OTHER BUSINESS.

There was no other business to come the Planning and Zoning Commission.

8. ADJOURN.

There being no additional business, the meeting was adjourned at 7:00 P.M.
