MINUTES
PLANNING AND ZONING COMMISSION
July 12, 2005

1. CALL TO ORDER.

The regular meeting of the Marion Planning and Zoning Meeting was called to order at 6:03 PM by Chairman Seidl.

2. ROLL CALL.

Members Present: Golden, Seidl, Nesteby, Neighbor, Adamson and Olson
Members Absent: Mooney, Techau, Preussner
Staff Present: Treharne, Hockett and Steigerwaldt

3. MINUTES -

a. Planning and Zoning – June14, 2005
b. Zoning Board of Adjustment – June 21, 2005
c. City Council – June 2 and 16, 2005

Motion by Golden seconded by Olson to approve the June 14, 2005 minutes as submitted.

All “ayes” motion carried

4. PLATS -

a. CPC Resolution No. 05-18 regarding Prairie Ridge Estates Fifth Addition Revised Preliminary Plat for property located east of Highway 13, south of Fernow Road in Marion, Iowa.  (Case #05-60)

Hockett presented the staff report regarding the proposed revision to the Preliminary Plat for the property.  Hockett stated that staff was requesting that a sidewalk connection be made between the two portions of the subdivision to ensure adequate pedestrian movement through the development.

Terry Chew, Anderson-Bogert Engineers, representing the applicant explained that the revision will result in several double fronted lots being removed from the development and that the new street locations create a safer situation at Highway 13.

There were no additional comments for or against the proposed request.

Motion by Olson, seconded by Golden, to recommend approval of CPC Resolution No. 05-18 regarding Prairie Ridge Estates Fifth Addition Revised Preliminary Plat for property located east of Highway 13, south of Fernow Road in Marion, Iowa. 

All “ayes” motion carried.

b. CPC Resolution No. 05-19 regarding Hunters Field Addition Preliminary Plat located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa.  (Case #05-61)

Hockett presented the staff report regarding the proposed Preliminary Plat.  Hockett stated concerns regarding the proposed radius of the street located in the northeast corner of the development and stated that the street would be required to meet Metro Street Standards.

Steigerwaldt, presented information related to stormwater and stated concerns regarding the sizing of the proposed detention pond.

Ghassan El-Farhan Halloush, representing the developer stated that most of staffs concerns had been addressed; however, they are agreeable to staff conditions and will make all changes and provide information prior to the preliminary plat being forwarded to the City Council

Craig Tobin, 5150 Elderton Drive, stated concerns regarding the phasing of the development and Elderton Drive being used as a cut through in the future to 10th Street.

There were no additional comments for or against the proposed preliminary plat.

Motion by Nesteby, seconded by Neighbor to recommend approval of CPC Resolution No. 05-19 regarding Hunters Field Addition Preliminary located west of Winslow Road, south of Huntington Hills Drive in Marion, Iowa, subject to staff comments.

  All “ayes” motion carried.

5. REZONING -

a. Public hearing regarding Linda Peterson request to rezone property located at 940 8th Avenue in Marion, Iowa from O-1, Office / Transitional to C-1, Neighborhood Commercial.

Hockett presented the staff report regarding the rezoning request.  Hockett stated several concerns regarding the proposed rezoning request primarily related to the permitted uses in the C-1, Neighborhood Commercial District that could lead to potential conflicts with adjacent residential uses.  Hockett recommend denial of the request based on potential incompatibilities with adjacent uses.

Lois Foster, representing the applicant stated that the property has been for sale in excess of 18 months and that the zoning amendment would allow them the ability to market the property to more potential buyers.

Linda Peterson, owner stated that it is not her intent to tear the home down for redevelopment, but make it more marketable to buyers seeking more flexibility with the use of the property.

There were no additional comments for or against the proposed rezoning amendment.

b. CPC Resolution No. 05-20 regarding Linda Peterson request to rezone property located at 940 8th Avenue in Marion, Iowa from O-1, Office / Transitional to C-1, Neighborhood Commercial.  (Case #05-09)

Nesteby stated that he saw little concern with the rezoning request and stated that the adjacent property is zoned C-1, as well as the property across the street.

Olson stated her understanding with the need to make the property as appealing as possible to potential buyers, but was concerned about some of the uses permitted

Motion by Seidl, seconded by Olson to recommend denial regarding Linda Peterson request to rezone property located at 940 8th Avenue in Marion, Iowa from O-1, Office / Transitional to C-1, Neighborhood Commercial based on concerns that could lead to potential conflicts with adjacent residential uses.

Roll Call:

Ayes:   Golden, Seidl, Neighbor, Adamson and Olson
Nayes:   Nesteby

Motion passed on 5-1 roll call vote.

6. OTHER BUSINESS.

Treharne updated the Commission regarding the status of the Zoning Code Update.

7. ADJOURN.

There being no additional business to come before the Planning and Zoning Commission the meeting was adjourned at 8:45 PM.
