MINUTES
PLANNING AND ZONING COMMISSION
JUNE 8, 2004

1. CALL TO ORDER.

The regular meeting of the Marion Planning and Zoning Commission was called to order at 6:00 P.M.

2. ROLL CALL.

Members Present: Mooney, Techau, Seidl, Neighbor, Nesteby, Adamson (late 6:05pm), Olson, Preussner
Members Absent: Golden
Staff Present: Treharne, Hockett, Steigerwaldt

3. MINUTES -

c. City Council – May 6 and 20, 2004

Motion by Mooney, seconded by Techau to approve the minutes of the May 11, 2004 Planning and Zoning Commission meeting as submitted.

All “ayes” motion carried.

4. COMPREHENSIVE PLAN AMENDMENT -

a. Public hearing regarding an amendment to the Future Land Use Map of the Marion Comprehensive Plan to include previously undesignated property located east of Highway 13, south of County Home Road to a Civic Uses designation.  (City Initiated)

Seidl declared the public hearing regarding the Future Land Use Map amendment open.

Treharne presented the staff report regarding the proposed amendment.  Treharne indicated that recent studies show the area east of Highway 13 could be provided with both City sewer and water and due to recent annexations and pattern of growth, the area should be included within the City’s Future Land Use Map.

Karmin Bradbury, representing Bluesteam Solid Waste Agency, inquired if the action being taken tonight was in response to the proposed expansion of the landfill.

Siedl stated that the Commission has taken no action or made any recommendations regarding the proposed expansion of the landfill and that the decision tonight would not be based on any proposed expansion.

There were no other public comments regarding the proposed amendment to the Future Land Use Map amendment.

Siedl inquired to the ability to provide water to the area and if any limitations of use of the property would occur if the amendment was approved.

Treharne indicated that water could be made available to the property and pressure to the lines would be improved as development occurs to the south that would create a looped system.  Treharne stated that land use designation of the property does not limit the ability for the Abbe Center and County buildings to expand on this site.  If the property should be sold and developed for other uses such as commercial or residential, then the designation would have to be amended at that time, which is not unusual for new developments. 

Nesteby inquired as to why a larger area was not considered for this amendment.

Treharne indicated that past inquiries by the Abbe Center for water and the growth of the City in this direction prompted the City Council to propose this amendment.  Treharne indicated that as time allows staff will be reviewing the Future Land Use Map for the entire area and this area may be revisited at that time.

Mooney stated that since the original plan was finished in 1998 the growth of Marion to the north has been expanding faster and further than originally anticipated and updates to the map are needed and should be explored, not only for this location but everything north of 35th Avenue.

Seidl concurred with Mooney on the need to update the entire Land Use Map.

b. CPC Resolution No. 04-19 regarding an amendment to the Future Land Use Map of the Marion Comprehensive Plan to include previously undesignated property located east of Highway 13, south of County Home Road to a Civic Uses designation.  (City Initiated)

Motion by Adamson, seconded by Mooney to recommend approval of CPC Resolution No. 04-19 regarding an amendment to the Future Land Use Map of the Marion Comprehensive Plan to include previously undesignated property located east of Highway 13, south of County Home Road to a Civic Uses designation. 

All “ayes” motion was carried.

5. PLATS -

a. CPC Resolution No. 04-20 regarding Edgebrooke Estates Addition Preliminary Plat located south of 35th Avenue, east of Indian Creek Road (Ridgewood L.L.C.).  (Case #04-52)

Hockett presented the staff report regarding the proposed preliminary plat.  Hockett indicated that the developer has platted the property with the new 35th Avenue alignment at the Indian Creek Road intersection.

Roger Cousins, 3650  Brookside Drive, presented photographs of the recent storm event and stated that he hoped the Commission and Council are aware of stormwater issues in the area.

Alan Witt, Hall and Hall Engineers, representing the applicant indicated that he is available for any questions.

Steigerwalt, indicated that when 35th Avenue is constructed west of Indian Creek Road it will act as buffer from where the stormwater will be discharged and the homes on Brookside Drive.

Motion by Techau, seconded by Pressuner to recommend approval of CPC Resolution No. 04-20 regarding Edgebrooke Estates Addition Preliminary Plat located south of 35th Avenue, east of Indian Creek Road. 

All “ayes” motion carried.

b. CPC Resolution No. 04-21 regarding Champions Estates Addition Preliminary Plat located east of Lucore Road, north and south of Artesian Road (Gary and Robin Holub/G.S. Enterprises).  (Case #04-69)

Hockett presented the staff report regarding the proposed preliminary plat.  Hockett stated that the proposed development meets all subdivision and zoning requirements.  He stated wetlands are identified along the eastern boundary and will be further reviewed at the time of final platting, but the preliminary plat meets the intent of the subdivision and zoning regulations.

Dan Schmidt, Brain Engineering, representing the applicant stated that if the wetland report findings should come back requiring revisions, a revised preliminary plat would be prepared to address the concerns.

Mary Tuecke, 3700 Artesian Road. expressed concern about the amount of water and size of lots.

Schmidt indicated that all lots are sized to accommodate the anticipated housing product.

George May indicated that the home sizes would be comparable to Glen Rock Farms, with the larger lots accommodating larger homes.

Motion by Mooney, seconded by Adamson, to recommend approval of CPC Resolution No. 04-21 regarding Champions Estates Addition Preliminary Plat located east of Lucore Road, north and south of Artesian Road (Gary and Robin Holub/G.S. Enterprises).

All “ayes” motion carried.

c. CPC Resolution No. 04-22 regarding Pheasant Trail Seventh Addition Preliminary Plat and Preliminary Site Development Plan located south of 29th Avenue east of 44th Street (Pheasant Ridge, L.L.C.).  (Case #04-70)

Hockett presented the staff report regarding the proposed preliminary plat and preliminary site development plan.  Hockett explained that the internal streets would be private and that 4-plex condominium units were being proposed for the site.

Motion by Nesteby, seconded by Pressuner to recommend approval of the CPC Resolution No. 04-22 regarding Pheasant Trail Seventh Addition Preliminary Plat and Preliminary Site Development Plan located south of 29th Avenue east of 44th Street. 

6. OTHER BUSINESS.

There was no other business to come before the Planning and Zoning Commission.

7. ADJOURN.

There being no additional business to come before the Commission the meeting was adjourned at 8:03 P.M.
