MINUTES
PLANNING AND ZONING COMMISSION
OCTOBER 11, 2005
1. CALL TO ORDER.
The regular monthly meeting of the Marion Planning and Zoning Commission was called to order by Chairperson Siedl at 6:00PM.
2. ROLL CALL.
Members Present: Mooney, Pressuner, Adamson, Mooney, Siedl, Neighbor, Golden, Olson,
Members Absent: Nesteby
Staff Present: Treharne, Hockett, Steigerwaldt
3. MINUTES -

Motion by Mooney, seconded by Pressuner to approve the minutes from the September 13, 2005 meeting as written.
All “ayes” motion carried.
4. PLATS -
a. CPC Resolution No. 05-33 regarding Briargate Addition to Marion located between 29th Avenue and 35th Avenue, east and west of 44th Street (63 lots). (Case #05-68)
Hockett presented the staff report regarding the proposed preliminary plat. Hockett stated that the property is currently zoned R-4 west of 44th Street and R-2 east of 44th Street. The developer is proposing condominium units similar to what the developer has constructed to the south of 29th Avenue. Hockett stated that staff was supportive of the rezoning at the time it was approved, however had reservations regarding allowing direct condominium access onto public streets and could not support the site development plan presented with the preliminary plat that showed six condominium buildings onto REC Drive and the two buildings onto Churchhill Drive.
Hockett stated that staff was concerned about the number and width of driveways onto public streets, lack of green space along the public street and lack of onstreet parking available due to number and width of driveways. Hockett stated that the Planning Department has expressed concern regarding the last 3 developments with a condominium component with direct access to the public streets.
Steigerwaldt stated that the proposed stormwater management system proposed meets the design criteria however he would like to see the outlet structure to the north detention pond moved further to the west to allow the water more opportunity to disperse before entering the natural drainage way through the Morris property.
Harriot Morris, 5616 Winslow Road stated that she objected to proposed preliminary plat as it does not adequately address stormwater that will be allowed to flow through her property.
Steigerwaldt explained that in the event of a 100 year storm the detention ponds would hold that water and release it onto her property at a 5 year storm rate so the total water going through her property would be the same, but the length of time would be much slower.
Adamson Arrived 6:20PM
Chad Pelling, Hall and Hall Engineers, representing the applicant stated that the storm water plan meet the design standards and that this development will detain and release water created by this development as Steigerwaldt explained.
There was no additional questions for or against the proposed request.
Motion by Mooney, seconded by Techau to recommend approval of CPC Resolution No. 05-33 regarding Briargate Addition to Marion located between 29th Avenue and 35th Avenue, east and west of 44th Street (63 lots). (Case #05-68)

Motion to approve CPC Resolution No. 05-33 FAILS.
b. CPC Resolution No. 05-32 regarding KPPC First Addition to Linn County located east of Council Street, north of Boyson Road (2 lots). (Case #05-70)
Hockett presented the staff report regarding the proposed plat. Hockett stated that the plat is located outside of Marion’s service area, but is located within 2 miles of the corporate limits, thus the city’s review of the plat. Hockett stated that the lot 2 is proposed for construction of a Church and lot one at this time will remain undeveloped. Sewer is not immediately available to the property and that lot 1 will be undeveloped until sewer is available, which will be extended from the sewer currently located along Alburnett Road.
Donna Drexell, representing the KPPC Church stated that she was available if there was any questions.
There was no public comments for or against the proposed plat.
Motion by Techau, seconded by Mooney to recommend approval of CPC Resolution No. 05-32 regarding KPPC First Addition to Linn County located east of Council Street, north of Boyson Road (2 lots). (Case #05-70).
All “ayes” motion carried.
5. OTHER BUSINESS.
There was no additional business to come before the Planning and Zoning Commission.
6. ADJOURN.
There being no additional business the meeting was adjourned at 7:23PM
