MARION PLANNING AND ZONING COMMISSION
September 12, 2006
1. CALL TO ORDER.
Vice Chairman Phil Seidl called the regular monthly meeting to order at 6:03 PM.
2. ROLL CALL:
Members Present: Mooney, Seidl, Techau, Golden, Neighbor, Krigbaum
Members Absent: Olson, Preussner, Nesteby

Motion by Mooney, seconded by Techau to approve the August 8, 2006 Planning and Zoning Commission minutes as submitted.
All “ayes” motion carried.
4. COMPREHENSIVE PLAN AMENDMENT -
a. Public hearing regarding a proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan amendment to change the designation from Parks and Recreation to Office/High-Intensity Mixed Use for property located east of Armar Drive, south of Marion Boulevard (City of Marion/Anace Aossey).
Seidl declared the public hearing regarding the proposed future land map amendment open.
Hockett presented the staff report regarding the proposed land use amendment. Hockett stated that the original designation of Parks and Recreation was done in 1999 due to approximate flood plain elevations and topographic issues. However, as landowners look to develop they have identified small relatively level areas outside of the flood plain that could be developed. The developer is proposing an office development for the identified property and to accommodate the proposed rezoning requires an amendment to the future land use map.
Jon Dusek, 4293 Foxview Drive, stated that he was in favor of both the amendments to the Future Land Use Map as well as the proposed rezoning requests.
Ace Aossey, 1745 Applewood Place, stated that they have leased the property that they are seeking to rezone from the City for some time and this rezoning would assist them in development of the property and Marion receiving an additional 42 acres of park and trail land.
There being no additional comments for or against the proposed request the public hearing was closed.
b. CPC Resolution No. 06-23 regarding a proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan amendment to change the designation from Parks and Recreation to Office/High-Intensity Mixed Use for property located east of Armar Drive, south of Marion Boulevard (City of Marion/Anace Aossey).
Motion by Mooney seconded by Techau, to recommend approval of CPC Resolution No. 06-23 regarding a proposed amendment to the Future Land Use Map of the Marion Comprehensive Plan to change the designation from Parks and Recreation to Office/High-Intensity Mixed Use for property located east of Armar Drive, south of Marion Boulevard (City of Marion/Anace Aossey).
All “ayes” motion carried.
5. REZONINGS -
a. Public Hearing regarding requests to rezone properties located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted, R-2, Medium Density Single-Family Residential and R-3, Two-Family Residential to 0-2, Office Park. (City of Marion/Anace Aossey).
Hockett presented the staff report regarding the proposed rezoning request. Hockett stated that the proposed rezoning is consistent with the proposed future land use map amendment that was previously presented.
There was no comments for or against the request, the public hearing was closed.
b. CPC Resolution No. 06-21 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted and R-3, Two-Family Residential to 0-2, Office-Park (Parcel C and H). (City of Marion/Anace Aossey). (Case #06-06)
Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 06-21 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from A-1, Rural Restricted and R-3, Two-Family Residential to 0-2, Office-Park (Parcel C and H). (City of Marion/Anace Aossey).
All “ayes” motion carried.
c. CPC Resolution No. 06-22 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from R-2, Medium Density Single-Family Residential to 0-2, Office Park (Parcel D) (Anace Aossey). (Case #06-07)
Motion by Techau, seconded by Mooney to recommend approval of CPC Resolution No. 06-22 regarding a request to rezone property located east of Armar Drive, south of Marion Boulevard from R-2, Medium Density Single-Family Residential to 0-2, Office Park (Parcel D) (Anace Aossey).
All “ayes” motion carried.
d. Public hearing regarding a request to rezone property located between 49th Street and 50th Street on a northerly extension of 49th Street from R-2, Medium Density, Single-Family Residential to R-4, Four Family Residential. (Lance and Karen Dunn)
Hockett presented the staff report regarding the proposed rezoning request. Staff was recommending denial of the request based on the lack of compatibility with the surrounding neighborhood to the west.
Ghassan Halloush, Alltrans Inc., 4403 1st Avenue SE, Suite 301 stated that the project is similar to what has been built to the north and east and that it is the best use of the land.
Lynn Dunn, 3445 Coffee Lane, stated that the units would be similar to what is existing on 50th Street. He stated that the placement of single family homes adjacent to the existing town homes would make them difficult to sell.
Rich Niemier, 1845 48th Street submitted a petition from the neighborhood opposing the rezoning of the property from single-famliy to multi-family. He stated he is also concerned about the scale of the buildings being much larger than the existing single-family homes.
Dan Skogen, 1970 50th Street, stated his opposition to the larger condominium units in the area.
Mike Mills, 1935 48th Street, stated he felt condominium units would dwarf the single-family homes and that this is not a good use of the land when it is adjacent to single-family homes.
Joel Smart, 1740 48th Street, stated he felt the development would be to dense when adjacent to singl- family homes.
Jody Skogen, 1970 50th Street, said that the condominiums in the area and the condominiums proposed have no design features and have too many large blank walls.
Tiffany Fay, 1972 50th Street, stated that there was no need for more condominiums in the area.
Laura Rathke 1720 49th Street, stated that this is a single-family neighborhood and should remain a single-family neighborhood and not allow any more condominiums.
Mike Rathke 1720 49th Street, stated the same concerns regarding the rezoning that had previously been stated by his wife.
Seidl asked that Mr. Dunn respond to some of the comments concerning his project.
Lynn Dunn, 3445 Coffee Lane, indicated that he understands that the condominiums are larger than the typical single-family homes in the area, but many of these homes are also two story, the same height of his proposed condominiums.
Mooney stated he would prefer to see PD-R, Planned Development - Residential zoning to allow the neighbors a better chance to see what is being proposed and address staff’s concern regarding density. He stated he could not see himself supporting the request as presented tonight.
Golden indicated that she too would like to see PD-R, Planned Development - Residential zoning to have greater control over the proposed buildings to help address neighbors’ concerns.
Rick Niemier, indicated even if the project would be rezoned to PD-R concerns regarding scale of the project.
There were no additional comments for or against the proposed request. The public hearing was closed.
e. CPC Resolution No. 06-25 regarding a request to rezone property located between 49th Street and 50th Street on a northerly extension of 49th Street from R-2, Medium Density, Single-Family Residential to R-4, Four Family Residential. (Lance and Karen Dunn)
Motion by Techau, seconded by Krigbaum to recommend denial of CPC Resolution No. 06-25 regarding a request to rezone property located between 49th Street and 50th Street on a northerly extension of 49th Street from R-2, Medium Density, Single-Family Residential to R-4, Four Family Residential.
All “ayes” motion carried to deny the request.
f. Public hearing regarding a request to rezone property located at 600 35th Street from A-1, Rural Restricted to I-2, General Industrial (T & M Properties, LLP/Michael Borst and Thomas Borst).
Hockett presented the staff report regarding the proposed amendment to rezone property.
There was no public comment for or against the proposed request.
The public hearing was closed.
g. CPC Resolution No. 06-26 regarding a request to rezone property located at 600 35th Street from A-1, Rural Restricted to I-2, General Industrial (T & M Properties, LLP/Michael Borst and Thomas Borst).
Motion by Mooney, seconded by Neighbor to recommend approval of CPC Resolution No. 06-26 regarding a request to rezone property located at 600 35th Street from A-1, Rural Restricted to I-2, General Industrial (T & M Properties, LLP/Michael Borst and Thomas Borst).
All “ayes” motion carried.
6. OTHER BUSINESS.
There was no additional business to come before the Marion Planning and Zoning Commission.
7. ADJOURN.
