MINUTES
ZONING BOARD OF ADJUSTMENT
February 15, 2005

1. CALL TO ORDER.

 Vice Chair Barnes called the regular meeting of the Marion Zoning Board of Adjustment to order at 7:00 P.M.
 
2. ROLL CALL.

Members Present: Barnes, Gibson, Krigbaum, Van Note
Members Absent: Kent
Staff Present; Hockett, Treharne

3. ELECTION OF OFFICERS.

Motion by Van Note, seconded by Krigbaum to retain current officers.

All “ayes” motion carried

4. MINUTES –

Zoning Board of Adjustment –December 4, 2004.

Minutes from the December 4, 2004 Zoning Board of Adjustment were approved as submitted.

5. CONSENT CALENDAR.

a. Motion to receive and file all correspondence from applicants and staff reports regarding variance requests on the February 15, 2004 Marion Zoning Board of Adjustment agenda.

Motion by Krigbaum, seconded by Van Note to receive and file all correspondence from applicants and staff reports regarding variance requests on the February 15, 2004 Marion Zoning Board of Adjustment agenda.

All “ayes” motion carried

6. APPEALS -

a. Jean Tanner and Eric Tanner, 1801 S. 22nd Street, Marion, Iowa – Requesting a variance pursuant to Section 176.29-3E(1) of the Marion Code of Ordinances to allow a chip seal driveway in a residential zoning district.

ZBA Resolution No. 05-1 approving variance request.
ZBA Resolution No. 05-1 denying variance request.

Hockett presented the staff report regarding the proposed variance request. 

Gibson inquired if they approved this variance if it would apply to future development of the property.  Hockett explained that if approved, the variance is only for this driveway, further development of the property will require additional variance requests or construction to City standards.

Eric Tanner, 1801 S. 22nd Street, stated that he has received several estimates from different companies and the chip seal is the cheapest of the three alternatives.  He stated that the remainder of the property will remain in crop production with heavy farm equipment using a portion of the driveway to access the fields and that heavy equipment will just damage an asphalt or concrete driveway, while a chip seal will not crack as a result of the heavy equipment.

Jean Tanner, 1801 S. 22nd Street, stated that she is in favor of the proposed request.

There were no additional comments for or against the proposed request and the public hearing was closed.

Motion by Gibson, seconded by Van Note to approve ZBA Resolution No. 05-01 approving the variance request based on a finding that strict conformance with the standards of the Zoning Ordinance would result in undue hardships for the property owner due to heavy farm equipment using a portion of the driveway to access the fields and damaging an asphalt or concrete driveway.

7. ADJOURNMENT.

There being no further business to come before the Marion Zoning Board of Adjustment the meeting was adjourned 7:45 P.M.
