5. APPEALS -
a. City of Marion Park Board, Marion, Iowa – Request for a variance from Section 176.29-2H(3) of the Marion Code of Ordinances to allow a gravel driveway in a residential zoning district (Gill Park).
ZBA Resolution No. 05-8 approving variance request.
ZBA Resolution No. 05-8 denying variance request.
Hockett presented the staff report regarding the proposed variance request and explained that it is the applicant’s intent to hard surface the driveway when the additional 20 feet of property is dedicated to the City by the owner.
There was no public comment for or against the proposed request.
There was discussion regarding the timing of additional land acquisition. Hockett stated that this type of land acquisition occurs at time of development and he does not expect the land to be dedicated to the City until the owner/developer of the property is ready for the next phase.
Motion by Gibson, seconded by Van Note to recommend approval of the variance request for a length of time not to exceed five (5) years at which time a hard surface driveway must be installed or dedication of adjacent property for right-of-way.
All “ayes” motion carried
6. ADJOURNMENT.
