MINUTES
MARION PLANNING AND ZONING COMMISSION
APRIL 10, 2007
1. CALL TO ORDER.
The regular monthly meeting of the Marion Planning and Zoning Commission was called to order at 6:03 P.M. by Chairman Nesteby.
2. ROLL CALL.
Members Present: AbouAssaly, Golden, Krigbaum, Mooney, Neighbor, Nesteby, Preussner, Sherman
Members Absent: Seidl
Staff Present: Hockett, Treharne, Steigerwaldt
3. MINUTES -
a. Planning and Zoning – March 13, 2007
b. Zoning Board of Adjustment – No Meeting
c. Council – March 1 and 15, 2007
Motion by Mooney, seconded by Preussner to approve the March 13, 2007 Planning and Zoning minutes as submitted,
All “ayes” motion carried.
4. REZONING -
a. Public hearing regarding City-initiated rezoning of property located on Agate Street, north of Boyson Road from R-4, Four-Family Residential to R-2, Medium Density, Single-Family Residential.
Hockett presented the staff report regarding the proposed rezoning request. Hockett stated that the request comes from the City Council to ensure that the neighborhood continues to development in a manner similar to the existing neighborhood and prevent the encroachment of apartments and/or condominiums into the single-family detached neighborhood. He stated that staff recommends approval of the request as submitted with no conditions.
Jim Nelson, 2281 Agate Street stated that he supports the request to amend the zoning and submitted a petition signed by the residents of Agate Street.
Motion by Mooney, seconded by AbouAssaly to receive and file the submitted petition.
All “ayes” motion carried.
Mary Burbach, 2161 Agate Street, stated that she and her husband support the request to rezone the property to R-2 and protect the investments that many people have made on the street.
There were no additional comments for or against the request.
b. CPC Resolution No. 07-09 regarding City-initiated rezoning of property located on Agate Street, north of Boyson Road from R-4, Four-Family Residential to R-2, Medium Density, Single-Family Residential. (Case #07-03)
Motion by Mooney, seconded by Golden to recommend approval of CPC Resolution No. 07-09 regarding City-initiated rezoning of property located on Agate Street, north of Boyson Road from R-4, Four-Family Residential to R-2, Medium Density, Single-Family Residential.
All “ayes” motion carried.
5. ALLEY VACATION -
a. CPC Resolution No. 07-10 regarding T & V Properties, LLC request to vacate a portion of the west one-half of the east/west alley adjacent to Lot 4, Block 1, Hurlburt’s Addition (Case #07-01A)
Hockett presented the staff report regarding the proposed alley vacation request. Hockett stated that the alley is not currently being used for the general public and staff was supportive of the request to vacate subject to maintaining a utility / access easement over the property. He stated that the Marion Water Department has requested the easement to access their facilities to the south.
There were no comments for or against the proposed request.
Motion by Golden, seconded by AbouAssaly to recommend approval of CPC Resolution No. 07-10 regarding T & V Properties, LLC request to vacate a portion of the west one-half of the east/west alley adjacent to Lot 4, Block 1, Hurlburt’s Addition subject to utility / access easement being maintained on the property.
All “ayes” motion carried.
6. OTHER BUSINESS
Treharne updated the Commission on various Planning Department activities.
7. ADJOURN.
There being no additional business to come before the Planning and Zoning Commission the meeting was adjourned at 6:33 P.M.
