August 14, 2007

1. CALL TO ORDER.

Chairman Nesteby called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:05PM
 
2. ROLL CALL.
Members Present: Mooney, Seidl, Sherman, Nesteby, Krigbaum
                                AbouAssaly (Late 6:40)
Members Absent: Golden, Neighbor and Preussner
Staff Present: Treharne, Hockett, Steigerwaldt, Kaiser

3. MINUTES -

a. Planning and Zoning – July 10, 2007
b. Zoning Board of Adjustment – July 17, 2007
c. Council – July 12 and 19, 2007

Motion by Seidl, seconded by Mooney to approve the minutes from the July 10, 2007 meeting.  All “ayes” motion carried.

4. REZONING -

a. Public hearing regarding Robin Holub request to rezone property located at the northeast corner of 31st Street and Munier Road from A-1, Rural Restricted to C-3, General Commercial.

Hockett presented the staff report regarding the proposed rezoning request.  Hockett stated that the applicant had submitted proposed changes to the request to the City Council after the Planning and Zoning Commission had recommend denial of the request.  The Council requested that the Planning and Zoning Commission review the proposed changes and make a recommendation to the City Council.   Hockett stated that the proposed amendments primarily dealt with land use.

Scott Peterson, representing the applicant explained that the proposed uses in the district are designed to prohibit the uses that seemed to be more intense and out of character with the neighborhood.

There were no additional comments, the public hearing was closed.

b. CPC Resolution No. 07-21 regarding Robin Holub request to rezone property located at the northeast corner of 31st Street and Munier Road from A-1, Rural Restricted to C-3, General Commercial (Case #07-04)

Seidl stated that he would feel more comfortable with the property as PD-C, Planned Development - Commercial rather than a conditional zoning.

Motion by Mooney, seconded by Sherman to approve CPC Resolution No. 07-21 regarding Robin Holub request to rezone property located at the northeast corner of 31st Street and Munier Road from A-1, Rural Restricted to C-3, General Commercial.

Nesteby stated that the City needs to look beyond the immediate use of the land and more to the future of the property and that C-3 may not be best use.

There being no additional discussion, the motion failed (5-1) Mooney voting to approve.

5.  ALLEY VACATION -

a. CPC Resolution No. 07-24 regarding a request to vacate and sell the north one-half of the north/south alley between 10th and 11th Avenues, adjacent to 1915 11th Avenue.  (Galen and Connie Glick, 1915 11th Avenue)

Hockett presented the staff report regarding the proposed alley vacation.  Hockett stated that the alley does not appear to have been used by anyone other than the applicant.  Hockett stated that if approved a utility / sanitary sewer easement would be placed on the property.

Galen Glick, 1915 11th Avenue, stated the reason for the request is to clean up the property and ensure that he always has access to his garage.

Motion by Seidl, seconded by Mooney to approve CPC Resolution No. 07-24 regarding a request to vacate and sell the north one-half of the north/south alley between 10th and 11th Avenues, adjacent to 1915 11th Avenue.

All “ayes” motion carried.

6. CONDITIONAL USE -

a. CPC Resolution No. 07-25 regarding a conditional use request to allow a watchman’s living quarters in the C-4, Warehouse / Commercial zoning district located at 260 13th Street (Clyde Satterly, Owner/Sam Knudson, Lessee)

Hockett presented the staff report regarding the proposed conditional use request.  Hockett stated that staff believed that the proposal met the standards for review of a conditional use request.

Sam Knudson, presented pictures of the interior of the building and stated that he and his family would be the sole tenants of the watchman’s quarters with the remaining warehouse being used to accommodate their vending routes.

Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 07-25 regarding a conditional use request to allow a watchman’s living quarters in the C-4, Warehouse / Commercial zoning district located at 260 13th Street.

All “ayes” motion carried.

Mooney removed himself from the Commission as the following agenda items present a conflict.

7. REZONING

a. Public hearing regarding Virginia M. Duffy and Mooney-Engle Land Company, LLC request to rezone property located east of N. 10th Street, south of Shamrock Woods in from Linn County A to R-2, Medium Density, Single-Family Residential.

Kaiser presented the staff report regarding the proposed rezoning, indicating that the proposed rezoning is compatible with both the Comprehensive Future land use map as well as adjacent property zoning and uses.

There were no public comments for or against the proposed request.

b. CPC Resolution No. 07-22 regarding Virginia M. Duffy and Mooney-Engle Land Company, LLC request to rezone property located east of N. 10th Street, south of Shamrock Woods in from Linn County A to R-2, Medium Density, Single-Family Residential.  (Case #07-06)

Motion by Seidl, seconded by AbouAssaly to recommend approval of CPC Resolution No. 07-22 regarding Virginia M. Duffy and Mooney-Engle Land Company, LLC request to rezone property located east of N. 10th Street, south of Shamrock Woods in from Linn County A to R-2, Medium Density, Single-Family Residential.

All “ayes” motion carried.

8. PLATS -

a. CPC Resolution No. 07-23 regarding Turning Stone Addition Preliminary Plat located east of N. 10th Street, south of Shamrock Woods (Virginia M. Duffy and Mooney-Engle Land Company, LLC).  (Case #07-62)

Hocket indicated that the applicant has requested that this item be tabled until a future meeting to allow staff and the developer additional time to adequate review the request and address City comments.

9. OTHER BUSINESS

a. CPC Resolution No. 07-26 regarding placement of Communication Tower Array on 36.76 acres located south of Echo Hill Road, west of Alburnett Road in Linn County.  (Request for review by Linn County Planning and Zoning Commission) (Ricki and Julie Boyle, Owners)

Hockett presented the staff report and requested the item be tabled as additional information regarding the request just became available and staff needs additional time to review.

Motion by Seidl, seconded by Sherman to table CPC Resolution No. 07-26 regarding placement of Communication Tower Array on 36.76 acres located south of Echo Hill Road, west of Alburnett Road in Linn County.

All “ayes” motion carried.

b. CPC Resolution No. 07-27 regarding the Urban Renewal Plan for the Central Corridor Urban Renewal Area.

Treharne presented the proposed Urban Renewal Plan that would replace the Central Business District and 7th Avenue revitalization Plans.

There were no comments for or against.

Motion by Mooney, seconded by Seidl to recommend approval of
CPC Resolution No. 07-27 regarding the Urban Renewal Plan for the Central Corridor Urban Renewal Area.

All “ayes” motion carried.

10. ADJOURN.

There being no further business to come before the Commission, the meeting was adjourned at 8:15 P.M.
