MINUTES
MARION PLANNING & ZONING COMMISSION
DECEMBER 12, 2006
1. CALL TO ORDER.
Chairman Nestby called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00PM.
2. ROLL CALL.
Members Present: Sherman, Techau, Nesteby, Neighbor, Preussner Krigbaum, Mooney and Seidl
Members Absent: Golden
Staff Present: Treharne, Planning & Development Director
Hockett, Asst. Planning & Development Director
Steigerwaldt, Assistant City Engineer
3. MINUTES -
a. Planning and Zoning – November 14, 2006
b. Zoning Board of Adjustment – No Meeting
c. Council – November 2 and 16, 2006.
Motion by Preussner, seconed by Krigbaum to approve the minutes as submitted from the November 14, 2006 meeting as submitted.
All “ayes” motion carried.
4. ZONING -
a. Public hearing regarding Robert Burger, Burger Homes and Development, Inc. request to rezone property located south of Boyson Road, west of Geode Street in Marion from A-1, Rural Restricted to R-3, Two-Family Residential.
Hockett presented the staff report regarding the proposed amendment to the zoning map. Hockett stated that the property is currently designated as Urban Residential on the Marion Future Land Use Map which typically permits R-3, Two Family Residential zoning adjacent to R-2, Medium Density Single Family zoning districts.
Hockett stated that staff supports the request as it is compatible with the adjacent land uses and is consistent with the Future Land Use Map of the Comprehensive Plan
Carl Knapp, 100 Alburnett Road, stated concerns with stormwater and detention issues.
John Nelson, 1960 Geode Street stated opposition to duplex and only supports single family developments adjacent to single family homes.
Don Klosterman, stated concerns regarding the ditch and the lack of maintenance.
Bob Hoffman, 1120 Aggete Circle, stated that he would like to see consistent development with the single family homes in the area and is opposed to the rezoning.
Steve Pinie 330 Alburnett Road, stated his opposition to the proposed request.
Bob Burger, Burger Development and Custom Homes, addressed the issues raised by the adjacent property owners, Mr. Burger stated that the ditch will be maintained and the property will be an assest to his development when he is finished.
Mooney inquired if Mr. Burger had a concept plan for the development at this time.
Mr. Burger stated that he did not, however the density of the project will be similar to the adjacent property developed to the north and east. Mr. Burger stated that these homes will also be competitively priced. Mr. Burger also agreed to additional rear yard plantings as well as ranch style homes with standard roof pitches.
There was no other questions for or against the proposed request. The public hearing was closed at 6:40PM
b. CPC Resolution No. 06-39 regarding Robert Burger, Burger Homes and Development, Inc. request to rezone property located south of Boyson Road, west of Geode Street in Marion from A-1, Rural Restricted to R-3, Two-Family Residential. (Case #06-10)
Motion by Mooney, seconded by Krigbaum to recommend approval of CPC Resolution No. 06-39 regarding Robert Burger, Burger Homes and Development, Inc. request to rezone property located south of Boyson Road, west of Geode Street in Marion from A-1, Rural Restricted to R-3, Two-Family Residential subject to the following:
1. Two trees per unit to be planted along the rear property lines. Trees shall be a minimum of 2” caliper and 6’ tall.
2. Homes shall be ranch style.The motion was approved (7-1)
5. PLATS -
a. CPC Resolution No. 06-40 regarding Bloomington First Addition to Linn County, Iowa located south of Martin Creek Road, west of Hindman Road in Linn County. (Case #06-84)
Hockett presented the staff report regarding the proposed county plat. Hockett stated that the property was located outside of the future land use map service area however it is located within two miles of the corporate limits thus the need to review the plat. Staff recommend approval of the plat.
Motion by Mooney, seconded by Siedl to recommend approval of CPC Resolution No. 06-40 regarding Bloomington First Addition to Linn County, Iowa located south of Martin Creek Road, west of Hindman Road in Linn County.
All “ayes” motion carried (8-0)
6. OTHER BUSINESS.
Treharne updated the commission on the status of the zoning ordinance and hoped to have another worksession in February.
7. ADJOURN.
There being no additional business to come before the planning and zoning commission the meeting was adjourned at 7:12PM
