Marion Planning and Zoning Commission
October 9, 2007

1. CALL TO ORDER.

Vice Chair Mooney called the regular monthly meeting of the Marion Planning and Zoning Commission to order at 6:00 PM.
 
2. ROLL CALL.

Members Present: Mooney, Golden, AbouAssaly, Seidl, Preussner,
                                 Neighbor
Members Absent: Nesteby, Krigbaum
Staff Present: Treharne, Hockett, Kaiser

3. MINUTES -

a. Planning and Zoning – September 11, 2007
b. Zoning Board of Adjustment – No Meeting
c. Council – September 6 and 20, 2007

Motion by Seidl, seconded by Neighbor to approve the minutes of the September 11, 207 Commission meeting as submitted.

All “ayes”, motion carried.

4. ALLEY VACATION -

a. CPC No. 07-31 regarding a request to vacate the north/south alley between 11th/12th Avenues sand 24th/25th Streets (Matthew J. Kinley Request, 1111 24th Street).  (Case #07-04A)

Hockett presented the staff report regarding the proposed alley vacation.  Hockett explained that the alley is not currently used and appears not to have been used for several years.  He stated that Staff recommends approval of the alley vacation subject to a 10 foot utility easement being maintained on the property.

Matt Kinley, 1111 24th Street, stated he was in favor of the request and will be willing to purchase the entire 10 feet adjacent to his property.

There were no additional public comments for or against the request.

Motion by Seidl, seconded by Golden to approve CPC No. 07-31 regarding a request to vacate the north/south alley between 11th/12th Avenues and 24th/25th Streets (Matthew J. Kinley Request, 1111 24th Street).

All “ayes” motion carried.

5. OTHER BUSINESS

a. Public hearing regarding an amendment to Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conversion systems.

Kaiser presented the staff report regarding the proposed wind energy conversion system ordinance.

There was discussion regarding total height limitations, placement of structures in residential zoning districts and terminology.

There were no comments for or against the proposed amendment.  The public hearing was closed.

b. CPC Resolution No. 07-30 regarding an amendment to Chapter 176 of the Marion Code of Ordinances regulating placement and operation of wind energy conversion systems.

Motion by Seidl, seconded by Preussner, to table any action regarding the proposed ordinance regulating placement and operation of wind energy conversion systems pending additional review by staff regarding the height and placement of structures.

c. Discussion regarding Self-Storage Facility Ordinance.

Hockett stated that the draft is still being reviewed and a public meeting will be held in the future with self storage garage owners to discuss the proposed ordinance prior to a public hearing.  He stated that additional information would be provided in the near future.

6. ADJOURN.

There being no further business to come before the Commission, the meeting was adjourned at 7:30 PM.
