Restrictive covenants typically are associated with residential developments are binding legal obligations written into the deed of a property by the seller. These covenants can be either simple or complex and can levy penalties against buyers / owners who fail to obey them.
The restrictive covenants are private agreement between the original seller and the land that your home is situated on. The City is not a party to these agreements and does not retain a copy nor enforce a violation of the restrictive covenant. You will need to retain private legal advice to pursue enforcement of the agreement.
Restrictive covenants can be located within your deed at time of purchase, they may be recorded with the Linn County Recorder's Office or if it is a relatively new development the original developer may be able to provide you with a copy of the covenants.
